§ 143-215. 48. Determining streamflows.
If litigation concerns the flow of water that would exist without an impoundment, the rate is deemed to be a specified seven-day, 10-year average unless a party offers a closer calculation. The Commission may make these determinations and require reports and inspections needed to do so.
