§ 52-1404. Lender response; effect.
If the lender issues a letter of commitment, the supplier may not get a lien for the stated amount. If the lender gives a written refusal to issue that letter, the lender’s and supplier’s rights are not affected by sections 52-1401 to 52-1411, and the lender’s prior perfected lien keeps its priority.
