TCA § 41-21-304 — Depositions
In civil cases, an inmate cannot be brought from the penitentiary to attend court personally; testimony may instead be taken by deposition if the party seeking it files an affidavit that the inmate is a material witness. In a state prosecution, the defendant may also take an inmate’s testimony by deposition with notice
