TCA § 26-3-112 — Defendants refusing to join in delivery bond
If more than one defendant is in the original execution and some do not join in a delivery bond, the bond’s sureties are first liable; if the surety pays the debt, that surety is substituted to the defendant’s rights against the other defendants.
