This section applies only to certain employers that use or store covered chemicals above specified amounts, or that hire agricultural laborers above specified payroll levels.
Covered employers must keep a workplace chemical list, update it at least annually, and make it available to agricultural laborers and their representatives.
Employers covered by this chapter must keep workplace chemical list forms, attachments, and related information, and make them available on request; the department also has recordkeeping and filing powers.
Chemical manufacturers and distributors must give MSDSs to purchasers, employers must keep current MSDSs and request them in writing if missing, and the department may require MSDS submissions by rule.
Existing labels on incoming chemical containers may not be removed or defaced, and agricultural laborers may not be required to work with a covered chemical from an unlabeled container except for a portable container intended for the laborer’s immediate use.
Covered employers and certain other entities must give the local fire chief emergency contact information and chemical records for qualifying stored products, and the fire chief may use those records for emergency planning.
The department must run an ongoing agricultural laborer training program and provide it in required counties; employers may not refuse to hire someone just because they lack the participation card.
The department must develop crop sheets with specified safety, training, contact, and rights information, and print them in English and Spanish with a limited English-only exception.
Employers covered by this section must give crop sheets to certain agricultural laborers, have them read at least once each work season, and provide related chemical timing information; the department also requires employers to offer basic safety and health information at first pay.
Covered employers must provide recommended protective clothing or devices beyond the standard clothing normally provided to agricultural laborers.
Agricultural laborers exposed to covered chemicals must be informed, get access to chemical lists and MSDSs, receive training and PPE, and be protected from retaliation or forced waivers.
The department may make rules and run outreach. It must give covered employers notice forms and publish information, and it may work with other organizations. Covered employers may also help provide outreach in the community with the department.
Giving information to an agricultural laborer does not change liability or other duties under other law.
The department must investigate written complaints about alleged chapter violations, can inspect workplaces with credentials, and may issue enforcement orders; employers can face civil and criminal penalties for certain false hazard disclosures.
An employer with overlapping duties under Chapter 502 and this chapter generally follows only the Hazard Communication Act, but must still comply with this chapter for agricultural laborers not covered by that Act.
This section defines several terms used in the chapter.
This section defines “proceeds” for this chapter and excludes certain cooperative association amounts.
A lien claimant must give notice before purchase and must send a certified-mail notice to the debtor before claiming the lien.
This section says when a lien attaches and when it is removed if notice and filing requirements are not met.
