Health and Safety Code § 242.044

Sec. 242.044. UNANNOUNCED INSPECTIONS. (a) The commission shall annually conduct at least one unannounced inspection of each institution. (b) For at least one unannounced annual inspection of an institution, the commission shall invite at least one person as a citizen advocate from: (1) the AARP; (2) the Texas Senior Citizen Association; (3) the department's Certified Long-term Care Ombudsman; or (4) another statewide organization for the elderly. (c) In order to ensure continuous compliance, the department shall randomly select a sufficient percentage of institutions for unannounced inspections to be conducted between 5 p.m. and 8 a.m. Those inspections must be cursory to avoid to the greatest extent feasible any disruption of the residents.
