Occupations Code § 2104.102

Sec. 2104.102. HEALTH REPORT. (a) On the filing of a permit application under Section 2104.101, the county clerk shall forward a copy of the application to the county health officer. (b) The county health officer shall make a written report to the commissioners court. A report made under this subsection must: (1) state whether the county health officer believes that the preparations described in the application would, if carried out, be sufficient to: (A) protect the community and the persons attending the outdoor music festival from health dangers; and (B) avoid a violation of Chapter 341, Health and Safety Code; and (2) be filed with the county clerk before the second day before the date of the hearing on the permit application. (c) The county health officer shall be present at the hearing on the permit application and may be called to testify by a person having an interest in the permit.
