Education Code § 51.256

Sec. 51.256. CONFIDENTIALITY. (a) Unless waived in writing by the alleged victim, the identity of an alleged victim of an incident reported under Section 51.252: (1) is confidential and not subject to disclosure under Chapter 552, Government Code; and (2) may be disclosed only to: (A) persons employed by or under contract with the postsecondary educational institution to which the report is made who are necessary to conduct an investigation of the report or any related hearings; (B) a law enforcement officer as necessary to conduct a criminal investigation of the report; (C) the person or persons alleged to have perpetrated the incident, to the extent required by other law; or (D) potential witnesses to the incident as necessary to conduct an investigation of the report. (b) A disclosure under Subsection (a) is not a voluntary disclosure for purposes of Section 552.007, Government Code. (c) Nothing in this section may be construed as prohibiting a victim from making a report to a law enforcement agency using a pseudonym form described by Article 58.102, 58.152, 58.202, or 58.252, Code of Criminal Procedure.
