Insurance Code § 848.110

Sec. 848.110. RIGHTS OF PHYSICIANS; LIMITATIONS ON PARTICIPATION. (a) Before a complaint against a physician under Section 848.107 is resolved, or before a physician's association with a health care collaborative is terminated, the physician is entitled to an opportunity to dispute the complaint or termination through a process that includes: (1) written notice of the complaint or basis of the termination; (2) an opportunity for a hearing not earlier than the 30th day after receiving notice under Subdivision (1); (3) the right to provide information at the hearing, including testimony and a written statement; and (4) a written decision that includes the specific facts and reasons for the decision. (b) A health care collaborative may limit a physician or group of physicians from participating in the health care collaborative if the limitation is based on an established development plan approved by the board of directors.
