Agriculture Code § 161.051

Sec. 161.051. MEMORANDUM OF UNDERSTANDING ON ENFORCEMENT OF COMMISSION POWERS. (a) The commission and the Department of Public Safety by rule shall adopt a joint memorandum of understanding that includes provisions under which Department of Public Safety officers are to check for health papers and permits when a livestock vehicle is stopped for other reasons in the regular course of the officers' duties. The memorandum shall require: (1) commission staff to provide information to Department of Public Safety officers regarding health papers and permits; (2) Department of Public Safety officers to report potential problems to the commission; (3) commission staff to investigate possible violations reported by Department of Public Safety officers; (4) Department of Public Safety officers to provide assistance when requested by the commission; and (5) commission personnel to notify the Department of Public Safety, when appropriate, of the location of commission roadblocks or special or night operations. (b) The commission and the Department of Public Safety shall review and update the memorandum not later than the last month of each state fiscal year.
