Natural Resources Code § 40.005

The General Land Office is the state’s lead agency for starting response to actual or threatened unauthorized oil discharges, under the commissioner’s direction. The Texas Commission on Environmental Quality may also take over response and cleanup for an unauthorized hazardous-substance discharge as soon as practicable
