Occupations Code § 801.407

Sec. 801.407. RIGHT TO HEARING. (a) A person is entitled to a hearing before the State Office of Administrative Hearings if the board: (1) refuses to examine the person; (2) denies the person's application for a license; (3) revokes or suspends the person's license; (4) places the person on probation; (5) reprimands the person; or (6) assesses an administrative penalty against the person. (b) A hearing conducted under this section is governed by Chapter 2001, Government Code. (c) The State Office of Administrative Hearings shall use the schedule of sanctions under Section 801.411 for any sanction imposed as the result of a hearing conducted by that office. (d) The board shall by rule prescribe notice procedures for proceedings under this subchapter. Acts 1999, 76th Leg., ch. 388, Sec. 1, eff. Sept. 1, 1999.
