Water Code § 7.107
Most civil penalties recovered by a local government under this subchapter must be split between the state and the local government, with the first $4.3 million divided equally; amounts above $4.3 million go to the state. There is an exception for suits involving Chapter 28 or Chapter 401, Health and Safety Code.
