Occupations Code § 351.357

Sec. 351.357. FITTING AND DISPENSING CONTACT LENSES. (a) Contact lenses may be fitted only by an optometrist, therapeutic optometrist, or licensed physician. (b) An ophthalmic dispenser may dispense contact lenses on a fully written contact lens prescription issued by an optometrist, therapeutic optometrist, or licensed physician. The ophthalmic dispenser may: (1) fabricate or order the contact lenses and dispense them to the patient with appropriate instructions for the care and handling of the lenses; and (2) mechanically adjust the lenses. (c) The ophthalmic dispenser may not measure the eye or cornea or evaluate the physical fit of the contact lenses in any way. (d) Notwithstanding Subsection (b), an optometrist, therapeutic optometrist, or licensed physician who issues a contact lens prescription remains professionally responsible to the patient.
