Government Code § 854.401

Sec. 854.401. ELIGIBILITY FOR SUPPLEMENTAL DISABILITY RETIREMENT ANNUITY. (a) A member as an employee of a municipal department included, as provided by Section 852.003, in the coverage of the supplemental disability benefits fund is eligible to retire and receive a supplemental disability retirement annuity if the member: (1) is eligible to receive a disability retirement annuity under Section 854.302; (2) is the subject of a certification and finding under Section 854.402, as well as a certification under the applicable finding provided by Section 854.303; and (3) filed an application for the benefits before January 1, 1989. (b) Any claim for supplemental disability benefits not filed with the board of trustees before January 1, 1989, is barred. Acts 1981, 67th Leg., p. 1876, ch. 453, Sec. 1, eff. Sept. 1, 1981.
