Education Code § 29.367

Sec. 29.367. SPECIAL EDUCATION NOTICE. (a) A certified educational assistance organization shall post on the Internet website established and maintained for the program and provide to each parent who submits an application for the program a notice that: (1) states that a private school is not subject to federal and state laws regarding the provision of educational services to a child with a disability in the same manner as a school district or open-enrollment charter school; and (2) provides information regarding rights to which a child with a disability is entitled under federal and state law if the child attends a school district or open-enrollment charter school, including: (A) rights provided under the Individuals with Disabilities Education Act (20 U.S.C. Section 1400 et seq.); and (B) rights provided under Subchapter A. (b) A private school in which a child with a disability who is a participating child enrolls shall provide to the participating parent a copy of the notice required under Subsection (a).
