Estates Code § 152.003
If emergency funds are requested for a decedent’s funeral or burial expenses, the applicant must disclose any written funeral or burial instructions from the decedent, attach them if available, and follow them. If no written instructions exist, the applicant may not allow cremation unless court permission is obtained.
