Utilities Code § 35.032

Sec. 35.032. COMMISSION REGISTRATION AND REQUIRED REPORTS. (a) An exempt wholesale generator or power marketer that sells electric energy in this state shall, not later than the 30th day after the date it becomes subject to this section: (1) register with the commission; or (2) provide to the commission proof that it has registered with the Federal Energy Regulatory Commission or has been authorized by the Federal Energy Regulatory Commission to sell electric energy at market-based rates. (b) The exempt wholesale generator or power marketer may register by filing with the commission: (1) a description of the location of any facility used to provide service; (2) a description of the type of service provided; (3) a copy of any information filed with the Federal Energy Regulatory Commission in connection with registration with that commission; and (4) other information required by commission rule. (c) An exempt wholesale generator or power marketer required to register under Subsection (a) shall file any report required by commission rule. Acts 1997, 75th Leg., ch. 166, Sec. 1, eff.
