Government Code § 432.003
A person discharged from the state military forces who is later charged with fraudulently obtaining the discharge may be tried by court-martial, and after apprehension is subject to this chapter while in custody for that trial. A person who deserted from the state military forces cannot avoid this chapter’s jurisdictio
