Civil Practice and Remedies Code § 134A.004
A claimant may recover damages for misappropriation, including actual loss, unjust enrichment, or a reasonable royalty. If willful and malicious misappropriation is proven by clear and convincing evidence, the fact finder may also award exemplary damages up to twice the subsection (a) award.
