Local Government Code § 87.042
If a county commissioner seat becomes vacant, the county judge must appoint a qualified precinct resident to fill it until the next general election; in counties over 300,000 population, the appointment must be made within 60 days, or the commissioners court must appoint by majority vote after day 61.
