Education Code § 30B.152
The commissioner must evaluate certain virtual instruction providers and set a standard for ineligibility. School districts or open-enrollment charter schools may use an ineligible provider only with commissioner approval and a finding that the ineligibility reasons will not affect the provider’s operation.
