Utilities Code § 40.051
The governing body of a municipally owned utility may decide whether the utility offers customer choice, and the utility may opt in by resolution after January 1, 2002. Once that choice is made, it cannot be undone, and Subchapters D and E of Chapter 33 do not apply to actions taken under this chapter.
