Government Code § 25A.012

Sec. 25A.012. REMOVAL; DISQUALIFICATION AND RECUSAL. (a) A business court judge may be removed from office in the same manner and for the same reasons as a district judge. (b) A business court judge is disqualified and subject to mandatory recusal for the same reasons a district judge is subject to disqualification or recusal in a pending case. Disqualification or recusal of a business court judge shall be governed by the same procedure as disqualification or recusal of a district judge. (c) If a business court judge determines on the judge's own motion the judge should not hear a case pending in the judge's court because the judge is disqualified or subject to recusal, the judge shall: (1) enter a recusal order; (2) request the administrative presiding judge of the business court to assign another judge of the business court to hear the case; and (3) take no further action in the case except for good cause as stated in the order in which the action is taken. (d) The administrative presiding judge is not required to assign a case described by Subsection (c) to a different division of the business court.
