Agriculture Code § 41.156

Sec. 41.156. COUNCIL MEMBERS. (a) A member of the council must be: (1) nominated by the entity qualified to collect the proceeds of and administer the beef check off program established by federal law in this state or, in the entity's absence, the certified organizations that composed the entity; and (2) appointed by the commissioner. (b) A council member serves a one-year term or until his or her successor is appointed. A council member may serve not more than six consecutive one-year terms, except that a council member who is elected to serve as an officer during the member's sixth consecutive one-year term may serve as chairman or past chairman for not more than two additional consecutive one-year terms. (c) The commissioner shall fill a vacancy on the council by appointment for the unexpired term from nominations received in accordance with Subsection (a). (d) A council member is not a state officer for purposes of Section 572.021, Government Code, solely because of the member's service on the council.
