Occupations Code § 551.008
The board may not adopt rules, regulations, or policies that violate Chapter 110 of the Civil Practice and Remedies Code. A person may raise a violation of this subsection as an affirmative defense in an administrative hearing or in a judicial proceeding under Chapter 37.
