The board of regents may impose an intercollegiate athletics fee at Prairie View A&M University, but only within the stated cap and approval conditions.
For expiration of this section, see Subsection (f). Sec. 54.5393. INTERCOLLEGIATE ATHLETICS FEE: PRAIRIE VIEW A&M UNIVERSITY. (a) The board of regents of The Texas A&M University System may impose an intercollegiate athletics fee on each student enrolled at Prairie View A&M University in an amount not to exceed $12.60 per semester credit hour, unless the amount is increased as provided by Subsection (b). (b) The amount of the fee per semester credit hour may be increased from one academic year to the next if: (1) the increase is approved by a majority vote of the students participating in a general student election held at the university for that purpose; or (2) the amount of the increase does not exceed five percent and is approved by a majority vote of the legislative body of the student government of the university. (c) The fee may not be imposed unless approved by a majority vote of the students of the university participating in a general student election held for that purpose. (d) A fee imposed under this section shall be used to develop and maintain an intercollegiate athletics program at the university. (e) A fee imposed under this section is in addition to any other fee authorized by law and may not be considered in determining the maximum amount of student services fees that may be imposed under Section 54.503. (f) This section expires September 1, 2018, except that this section does not expire if before the end of the 2017-2018 academic year the board of regents issues bonds that are payable wholly or partly from the fee. If the board of regents issues bonds as described by this subsection, the fee authorized by this section may not be imposed in any semester or session beginning after the date on which all of those bonds, including refunding bonds for the bonds, have been fully paid.
