Parks and Wildlife Code § 90.011
Violating Section 90.002, 90.008, or 90.0085 is an offense, usually a Class C misdemeanor, but a defendant with two or more prior convictions under Section 90.002 or 90.008 can be punished as a Class B misdemeanor.
