This preamble says the Kosovo Assembly is adopting an anti-corruption law and explains its policy aims.

This article says the law sets anti-corruption measures covering administrative corruption investigations, eliminating causes of corruption, conflicts between public office and profit-making activities for officials, limits on gifts, asset oversight, and restrictions for public tender participants.

This article defines key terms used in the law, including corruption, official person, responsible person in a legal entity, senior official, close relationship, serious corruption, and personal advantage.

Officials must report unlawful or improper requests in writing and later notify the competent public authorities and the Anti-Corruption Agency; abuse of office for personal or third-party interest is prohibited.

Officials must perform their duties conscientiously and professionally, without discrimination or privileges, and everyone is entitled to equal access, equal treatment, and free competition without corruption-linked harm.

A person who believes a decision was made because of corruption must submit a written request to the Kosovo Anti-Corruption Agency, which must review it and inform the person of the result within 60 days.

Public functions and duties must be carried out transparently and are subject to public scrutiny. No one may use a law or regulation that restricts transparency or publicity to conceal misuse of a public function or duty for personal gain.

Punët juridike që vijnë nga korrupsioni janë të pavlefshme; personi me interes të ligjshëm mund të kërkojë revokimin e tyre, dhe personi i dëmtuar ka të drejtë të kërkojë kompensim.

The Anti-Corruption Agency is to be established as an independent body, funded from Kosovo’s consolidated budget, and it decides how its funds are used.

The Agency is led by a director who must live permanently in Kosovo, be over 35, have a university education, and be suitable for the role.

Këshilli must start the director-selection process by public notice, recommend two candidates to the Kosovo Assembly, and the Assembly appoints one of them.

The Agency Director may be dismissed early if one of the listed conditions applies.

The Agency’s Director represents, directs, and organizes the Agency’s work, and performs the other duties and responsibilities of a head of an organ in accordance with law.

Këshilli miraton rregulla procedurale për Agjensionin, me propozim të Agjensionit.

The Agency may start administrative investigations about disciplinary measures against civil servants.

Public bodies, local authorities, and official persons must give the Agency the information it asks for and allow inspection of relevant documents.

Official persons must report corruption cases they learn about to the Agency, and the Agency must forward all such cases to the Public Prosecutor’s Office of Kosovo for review. A person who in good faith reveals information indicating corruption should not suffer harmful consequences.

People who prevent, detect, or investigate corruption have full independence and must not be subjected to undue pressure because of their work.

Agjensioni paraqet raportin vjetor të aprovuar nga Këshilli, dhe ai duhet të miratohet nga Kuvendi i Kosovës.

The Agency Council is established to oversee the Agency directly, has 9 members, members serve for two years and may be reappointed, and members are entitled to compensation for work-related expenses.

Këshilli i Agjensionit ka një kryesues dhe një zëvendëskryesues të zgjedhur nga anëtarët e tij për një mandat prej dy vjetësh.

The Agency Council must regularly oversee the Agency and the assets of officials working in the Agency, and the Agency Director must report every six months on that oversight and related findings. The Council may exercise its statutory functions only when at least half of its members are present.

The Agency must assign professional duties to the Agency Council and provide the technical conditions needed to perform the work.

The Agency has anti-corruption reporting, investigative, coordination, strategy, monitoring, advisory, and annual reporting functions.

A public official must act in the general interest when there is a conflict with personal interests.

Një person zyrtar/profesionist nuk duhet të bëjë veprimtari të tjera që sjellin të ardhura pa pëlqimin me shkrim të eprorit.

A personi zyrtar profesionist nuk mund të ushtrojë funksione administrative, mbikëqyrëse ose përfaqësimi në subjekte të caktuara private e publike, por ka një përjashtim të kufizuar për role bordi në disa institucione publike dhe ndërmarrje publike.

Një person zyrtar joprofesionist nuk duhet të ushtrojë funksione administrative ose përfaqësimi në disa subjekte kur posti i tij i jep rol mbikëqyrës ndaj tyre.

A person holding public office who previously had a position incompatible with public functions must resign from that position immediately after election, appointment, or confirmation of the mandate.

Nëse një person zyrtar vazhdon një aktivitet të papajtueshëm pas zgjedhjes, emërimit ose konfirmimit të mandatit, Agjensioni e paralajmëron dhe cakton një afat për ndalimin e aktivitetit ose heqjen dorë nga posti.

Contracting entities taking part in public tenders are to conduct business transactions with commercial enterprises in line with the cited public procurement law.

Agjensioni duhet të publikojë rregullisht në Gazetën Zyrtare listën e ndërmarrjeve komerciale; entitetet kontraktuese në tenderët publikë të nenit 33 nuk mund të bëjnë transaksione biznesi me to.

Some commercial enterprises and agricultural enterprises owned by officials or their close associates cannot receive public aid from the Consolidated Budget of Kosovo.

An official may not accept gifts or other benefits connected with their duties, except formal gifts and small occasional gifts.

Personi zyrtar duhet të regjistrojë të gjitha dhuratat e marra dhe vlerën e tyre në katalogun e dhuratave të mbajtur nga organi përkatës.

Public bodies required by law to keep gift catalogues must send copies for the previous year to the Agency by the last day of March of the following year.

If the Agency finds that an official person violated Articles 34 or 35 in a specific case, it must inform the body where that official person serves.

The Agency supervises the assets of senior officials and, if it finds a significant mismatch with declared asset information, it must notify the official’s workplace body and possibly other competent authorities.

The body where a senior official serves must notify the Agency seven days after that official starts or ends the post.

Agjensioni mbikëqyr pasurinë e personit zyrtar të lartë dhe e bën këtë duke u bazuar në informacionin që ky person dorëzon në një formular të posaçëm.

Brenda një muaji nga marrja e postit, personi zyrtar i lartë duhet t’i japë Agjensionit informacione për funksionin e tij, aktivitete të tjera, funksionet e mëparshme dhe gjendjen e pasurive të tij ose të personave të afërt.

The provision lists the types of assets and income included in a high public official’s asset information and lets the Agency ask for appropriate proof.

The senior official must report changes in the specified assets to the Agency every year by the end of March, and must comply with Agency requests for the listed information within 15 days.

If a senior official does not submit the required information on time, the Agency issues a warning, sets a new deadline of at least 15 days, may inform the relevant body, and later triggers salary reductions or dismissal steps if non-compliance continues.

Certain Agency members, employees, and collaborators must keep official information secret, and former employees covered by paragraph 1 must continue doing so for 15 years unless the Agency’s director decides otherwise.

Data collected under this law may be used only for the purposes set out in the law.

Agjensioni must keep and store records and related information/documents for 15 years.

Public contracting entities that take part in public tenders must pay a fine equal to 50% of the contract value if they are confirmed to have given the tender to a company covered by Article 33(3). Responsible persons of those entities must pay a fine of €5,000 to €50,000 if the prior violation is confirmed.

The relevant institutions must send the list of official persons and related persons to the Agency within 3 months after the Agency starts operating.

Personat zyrtarë duhet t’i dorëzojnë Agjensionit disa informacione dhe të përfundojnë ose të kërkojnë pëlqim për aktivitete të papajtueshme brenda 6 muajve pasi Agjensioni fillon funksionimin.

The director must invite the institutions named in Article 19(2) to appoint Council members within 15 days after the Agency starts operating, and must convene the constitutive meeting within 15 days after receiving notice that the last Council member has been appointed.

Kuvendi i Kosovës duhet të emërojë drejtorin vendor të Agjensionit brenda 60 ditësh pas shpalljes së ligjit; Agjensioni fillon funksionimin pasi të emërohet drejtori.

The Agency must confirm or submit the anti-corruption strategy within 12 months of starting work, submit procedural rules within 3 months of the director’s appointment, and issue internal organization rules within 15 days after those rules are approved.

This provision says the law takes effect after it is approved by the Kosovo Assembly, signed by the Assembly President, and proclaimed by the Special Representative of the Secretary-General.
