About this statute

This section gives the Act’s short title: the Town and Country Planning Act. This section defines key terms used in the Act. This section limits where the Act applies: it does not bind the Republic, generally does not apply to customary areas or mine townships, and the President may apply some or all of the provisions to customary areas by statutory order. In planned-development areas, the Republic must consult the planning authority before carrying out development or subdividing land. If there is no agreement, the planning authority may make written submissions to the Minister within 28 days, and the Minister then refers the matter to the Tribunal and makes the final decision. The Minister may appoint planning authorities, change their constitution, and prescribe their procedures, subject to notice and possible inquiry requirements.
