“This section gives the Act’s short title: the Commercial Travellers (Special Provisions) Act.”

This section gives the Act’s short title: the Commercial Travellers (Special Provisions) Act. This section defines “specified country” as a State or territory to which the Act applies under section 3, unless the context requires otherwise. The Minister may apply this Act to a State or territory by statutory order. The Minister may cancel a commercial traveller’s licence if he believes the holder lives in a specified country, after giving notice and allowing the holder time to show otherwise. The Licensing Authority must require evidence when someone applies to grant or renew a commercial traveller’s licence, to check that the licence holder would not be resident in a specified country.

2. Interpretation In this Act, unless the context otherwise requires— "speciﬁed country" means a State or territory to which the provisions of this Act are applied under the provisions of section three.

3. Application of this Act The *Minister may, by statutory order, apply the provisions of this Act to any State or territory speciﬁed in the order. *Applied to Southern Rhodesia by S.I. No. 396 of 1966.

The Minister may cancel a commercial traveller’s licence if he believes the holder lives in a specified country, after giving notice and allowing the holder time to show otherwise.

4. Cancellation of certain commercial traveller's licences under the Trades Licensing Act (1) Whenever the Minister has reason to believe that the holder of a commercial traveller's licence is resident in a speciﬁed country, he shall cause notice to be given to the holder that he proposes to cancel the licence unless, within such period as may be speciﬁed in the notice, the holder shows to the satisfaction of the Minister that he is not resident in a speciﬁed country. (2) A notice under subsection (1) shall be deemed to have been properly given if— (a) it is sent by registered post to the holder at the address shown on the commercial traveller's licence to which the notice relates; or (b) a copy of the notice is published in the Gazette. (3) If the holder of a commercial traveller's licence to whom a notice under subsection (1) has been given fails, within the period speciﬁed in the notice, to show to the satisfaction of the Minister that he is not resident in a speciﬁed country, the Minister shall, by Gazette notice, cancel his licence and such licence shall thereupon be null and void. (4) The Minister shall cause to be paid to the holder of a commercial traveller's licence which has been cancelled under the provisions of this section, a sum calculated by multiplying the amount of the fee paid in respect of that licence by one-twelfth of the number of completed months for which that licence would have continued to be valid, had it not been cancelled. § 5Restriction on grant or renewal of commercial traveller's licences under the Trades Licensing Act ................................ 2Provision

The Licensing Authority must require evidence when someone applies to grant or renew a commercial traveller’s licence, to check that the licence holder would not be resident in a specified country.

5. Restriction on grant or renewal of commercial traveller's licences under the Trades Licensing Act (1) No commercial traveller's licence shall be granted or renewed under the provisions of the Trades Licensing Act to any individual person, ﬁrm or company, if that person, ﬁrm or company is resident in a speciﬁed country. (2) For the purpose of enforcing the provisions of this section, the Licensing Authority under the Trades Licensing Act shall, on application being made for the grant or renewal of a commercial traveller's licence, require the applicant to satisfy him, by the production of such evidence as he may require, that, if the licence is granted or renewed, the holder of the licence will not be an individual person, ﬁrm or company resident in a speciﬁed country. 6. Issue of foreign commercial traveller's licence (1) The Minister may, on application being made in such form as he may require, and on payment of the fee prescribed by subsection (5), grant a licence, to be styled a foreign commercial traveller's licence, to any individual person, ﬁrm or company resident in a speciﬁed country. (2) The grant or refusal of a licence under this section shall be at the absolute discretion of the Minister, and the Minister may, on the grant of any such licence, attach such terms and conditions thereto as he thinks ﬁt. (3) In every licence granted under this section, there shall be speciﬁed— (a) the name and address of the holder of the licence; and (b) the period of the validity of the licence; and (c) any terms and conditions attached to the licence; and the licence shall be in the form prescribed in the Schedule. (4) A licence granted under this section shall, subject to the provisions of the licence, authorise the carrying on of the business of a commercial traveller for the purposes of the Trades Licensing Act to the same extent as is authorised by a commercial traveller's licence granted under the provisions of that Act. [Cap. 393] (5) There shall be payable, for the beneﬁt of the general revenues of the Republic, a fee of ﬁfteen thousand fee units in respect of every licence granted under this section.
