About this statute

This section gives the Act its short title and says it starts on a date the Ministry appoints by statutory instrument. This section defines key electricity terms and says no person may establish or carry on an undertaking unless it complies with this Act and the Energy Regulation Act. Subsection (1) does not apply to an undertaking if its plant is rated at less than 100 kilowatts and is used only for generating, transmitting, distributing, or supplying electricity for the operator’s own use. People who want to create and establish certain generating station works must comply with regulations and any Minister or Board requirements. The Minister may declare a transmission line to be a common carrier, and use of that line is then subject to regulations and agreed or Board-determined terms. An undertaking that wants to change its generating capacity or its right to buy power from outside Zambia must apply to the Minister for approval and file a full report.
