Adoption (Amendment) Act, 1997

1. This Act may be cited as the Adoption (Amendment) Act, 1997, and shall be read as one with the Adoption Act, in this Act referred to as the principal Act. Title Cap.54

2. Section two of the principal Act is amended by the insertion in the appropriate place of the following new definition: Amendment of section 2 " for!"ign infant " means a person who is below the age of eighteen years and is not a citizen of Zambia, but shall not include a person who is or has been martied.

3. Sectionfourofthe principal Act is amended by the insertion immediately after subsection (5) of the following new subsections: Amendment of section 4 (6) Notwithstanding subsection (5) an adoption order shall not be made in respect of a foreign infant- ( a) unless the infant resides in Zambia and the applicant is ordinarily resident ,in Zambia; (b) unless (he foregn infant has been continuously in the care and possession of the applicant for at least twelve consecutive months immediately preced­ ing the date of the order; (c) unless the applicant has at least three months before the period referred to in paragraph (b) notified the Commissioner of his intention to apply for an adoption order in respect of the foreign infant; and Single copies of this Act may be obtained from 1/ze Government Printer, P.O. (7) Subsections (]), (2); (3) and (4) shall apply with the necessary modifications to .a foreign infant adopted under subsection (6). Amendment of Scliedule

4. Section thirty�six of the principal Act is amended by the deletion of." three thousand penalty units " and the -subsitition therefor of "five hundred thousand penalty units"

5. The principal Act is amended by the deletion of theSchedule and the substitution therefor of the Schedule set out in the Appendix hereto.
