This section gives the Act its short title and says it is to be read together with the Adoption Act. This provision adds a definition of “foreign infant” as a person under 18 who is not a citizen of Zambia, but excludes anyone who is or has been married. An adoption order for a foreign infant may not be made unless the listed residency, care, notice, and permit conditions are met. This provision changes section 36 of the principal Act by replacing “three thousand penalty units” with “five hundred thousand penalty units.” This section replaces the Schedule in the principal Act with a new Schedule in the Appendix.

§ 1This Act may be cited as the Adoption (Amendment) Act,Short title

This section gives the Act its short title and says it is to be read together with the Adoption Act.

1. This Act may be cited as the Adoption (Amendment) Act, 1997, and shall be read as one with the Adoption Act, in this Act referred to as the principal Act. Title Cap.54

This provision adds a definition of “foreign infant” as a person under 18 who is not a citizen of Zambia, but excludes anyone who is or has been married.

Section two of the principal Act is amended by the insertion in the appropriate place of the following new definition: Amendment of section 2 " for!"ign infant " means a person who is below the age of eighteen years and is not a citizen of Zambia, but shall not include a person who is or has been martied.

Sectionfourofthe principal Act is amended by the insertion immediately after subsection (5) of the following new subsections: Amendment of section 4 (6) Notwithstanding subsection (5) an adoption order shall not be made in respect of a foreign infant- ( a) unless the infant resides in Zambia and the applicant is ordinarily resident ,in Zambia; (b) unless (he foregn infant has been continuously in the care and possession of the applicant for at least twelve consecutive months immediately preced ing the date of the order; (c) unless the applicant has at least three months before the period referred to in paragraph (b) notified the Commissioner of his intention to apply for an adoption order in respect of the foreign infant; and Single copies of this Act may be obtained from 1/ze Government Printer, P.O.
