About this statute

References to the Pharmacy and Poisons Board must be read as references to the Authority established by section 3, and the existing Board continues in office for three months from the appointed date. On and after the appointed date, the Authority takes over the Pharmacy and Poisons Board’s affairs, property, rights, and obligations, with related documents treated as if the Authority were the original party. If certain government property, rights, liabilities, or obligations are transferred to the Authority and registration is required, the Authority must apply in writing for registration, and the registration authority must record the transfer and related changes. If rights, liabilities, or obligations move to the Authority under this Act, the Authority and others have the same legal rights, powers, and remedies. Pending legal proceedings or applications may continue by or against the Authority. The Authority must appoint needed Pharmacy and Poisons Board staff as its officers, with the Minister’s approval, and must keep transferred public officers’ service conditions no less favourable than before.
