About this statute

This section defines key terms used in the Act. The Seed Control and Certification Institute within the Ministry responsible for agriculture is designated as the plant variety protection authority and must administer the Act. The Institute’s functions include registering plant varieties, promoting new varieties, protecting plant breeders’ rights, keeping records and catalogues, issuing licences, and compiling statistics. The Act requires a Registrar of the Institute and a Deputy Registrar, both public officers, and gives them administrative responsibilities. The Institute must recognise and protect the plant breeder's rights listed in this Part.
