Statute overview

About this statute

This section gives the Act its short title and says it comes into operation on 1st April, 2008. This section mainly defines terms used in the Act, including mining right, holder, mining area, prospecting area, and mineral. Mineral ownership and mining-related rights in minerals are vested in the President on behalf of the Republic. Mineral rights for prospecting, mining, and disposing of minerals are acquired and held under this Act, subject to its other provisions. A person must not prospect for minerals, mine, or process minerals unless authorised by a mining right or mineral processing licence. The Director of Geological Survey may grant a short written right to enter an area or do an aerial survey for reconnaissance, with conditions.
