§ 7Section 7Amendment

This section sets up the Board, names who appoints and elects its leadership, and bars certain people from being appointed as members.

7. (1) There is constituted the Board of the Agency which consists of the following part-time members appointed by the Minister: (a) a representative of the ministry responsible for industry; (b) a representative of the Attorney- General; (c) a representative of the Energy Regulation Board; (d) a representative of a higher education institution with knowledge and experience in measurements; (e) a representative of an association engaged in consumer protection, with knowledge and experience in matters relating to consumer protection; and (f) two persons from the private sector with knowledge and experience in matters relevant to this Act. (2) The ministries, institutions and organisations referred to in subsection (1) shall nominate their representatives for appointment by the Minister. (3) The Minister shall appoint the Chairperson from among the members of the Board referred to under subsection (1)(c) to (f). (4) The members shall elect the Vice- Chairperson from among themselves. (5) A person shall not be appointed as a member of the Board if that person is— (a) not a citizen; (b) an undischarged bankrupt; (c) legally disqualified from performing the functions of a member; or Metrology (Amendment) [No. 24 of 2026 621 (d) convicted of an offence under this Act or any other written law and sentenced to imprisonment for a term exceeding six months without an option of a fine. (6) The First Schedule applies to the Board.
