Purpose and legislative effect

“These Regulations are cited as the Factories (Plant Inspection and Examination Fees) Regulations, 2018, and they apply to factories, building operations, and works of engineering construction.”

These Regulations are cited as the Factories (Plant Inspection and Examination Fees) Regulations, 2018, and they apply to factories, building operations, and works of engineering construction. Steam boilers, steam receivers, and air receivers must be inspected periodically under Part VIII of the Act. A fee must be paid for each inspection or examination of a steam boiler, steam receiver, or air receiver when the inspection is done by an inspector or a person authorised by the Commissioner. When a steam boiler, steam receiver, or air receiver is due for inspection or examination, the Commissioner must notify the owner, user, or occupier by registered letter of the date and time, at least 10 days in advance. If a plant inspection or examination is delayed because the owner, user, or occupier was not prepared, a surcharge applies. The inspector must also issue an Inspection Report with a “Nil” entry for Maximum Permissible Pressure when the inspection cannot be carried out.

When a steam boiler, steam receiver or air receiver is due for inspection or examination by an inspector or a person authorised by the Commissioner, the Commissioner shall notify the owner or user of any such vessel or the occupier of the premises by registered letter of the date and time when such inspection or examination shall be carried out and that letter shall be sent to the owner, user or occupier, as the case may be, at least ten days before the proposed date of inspection. If a plant inspection or examination is delayed because the owner, user, or occupier was not prepared, a surcharge applies. The inspector must also issue an Inspection Report with a “Nil” entry for Maximum Permissible Pressure when the inspection cannot be carried out.

5. (1) Where an inspector or a person authorised by the Commissioner has arranged to inspect or examine a plant on a date and a time specified in a registered letter but is unable to carry out the inspection or examination at the prescribed time because of lack of preparation on the part of the owner, user or occupier, such owner, or user or occupier is liable to the following surcharges in addition to the applicable fees: Revocation of SI No. 106 of 2000 (a) where preparations may be made to allow the plant to be inspected or examined within one hour of the prescribed time, a surcharge of one thousand units; and (b) where preparations cannot be made to allow the inspection or examination to be carried out within one hour of the prescribed time, a surcharge equal to the basic fee. (2) An inspector shall, where an inspection or examination cannot be carried out for any reason, in addition to the surcharge, issue an Inspection Report showing a “Nil” entry against “Maximum Permissible Pressure” in respect of the steam boiler, steam receiver or air receiver to be inspected or examined and such Inspection Report shall remain in force until a time that further arrangements can be made to inspect or examine such steam boiler, steam receiver or air receiver.

§ 6Where a competent person suspends the operation of anyProvision

If a competent person suspends lifting machinery on safety grounds, the owner or user must pay a fee equal to one and a half times the basic inspection or examination fee, unless the suspension is because the machinery is being decommissioned.

6. Where a competent person suspends the operation of any lifting machinery on safety grounds, the owner or user of the lifting machinery shall pay a fee of one and half times the basic fee for the inspection or examination of the lifting machinery, except that where the suspension is due to decommissioning of the lifting machinery a suspension fee shall not be payable.
