These Regulations may be cited by their name, and they apply to factories, building operations, works of engineering construction, and non-factory buildings. This section defines “competent person” by reference to the Act and lists several items that count as “lifting machinery.” Owners or users of lifting machinery must pay the stated inspection or examination fees and must notify the competent person at least 14 days before the required inspection or examination due date. The Commissioner must notify the owner or user of lifting machinery by registered letter when an inspection or examination is due, and the notice must be sent at least 10 days before the proposed inspection date. If lifting machinery is not ready for an arranged inspection or examination, the owner or user must pay surcharges.

This section defines “competent person” by reference to the Act and lists several items that count as “lifting machinery.”

2. In these Regulations, unless the context otherwise requires— “competent person” has the meaning assigned to the words Interpretation in the Act; “lifting machinery” means a lift, hoist, chain, rope, lifting tackle, forklift, reach truck, lifting platform, stacking machine or crane.

§ 3An owner or user of any lifting machinery shall pay inProvision

Owners or users of lifting machinery must pay the stated inspection or examination fees and must notify the competent person at least 14 days before the required inspection or examination due date.

3. An owner or user of any lifting machinery shall pay in respect of an inspection or examination done by a competent person, an inspector or a person authorised by the Commissioner to do so, the appropriate fees specified in Parts I, II or III of the Schedule. (1) The owner or the user of any lifting machinery shall notify the competent person at least fourteen days before due date of the required inspection or examination of lifting machinery.

§ 4Section 4Provision

The Commissioner must notify the owner or user of lifting machinery by registered letter when an inspection or examination is due, and the notice must be sent at least 10 days before the proposed inspection date.

4. (2) When lifting machinery is due for inspection or examination by a competent person, the Commissioner shall notify the owner or user of that lifting machinery by registered letter of the date and time when such inspection or examination shall be carried out and that letter shall be sent to the owner or user, as the case may be, at least ten days before the proposed date of inspection. If lifting machinery is not ready for an arranged inspection or examination, the owner or user must pay surcharges.

5. (1) Where a competent person has arranged with the owner or user of any lifting machinery to inspect or examine it on a date and time specified in accordance with regulation 4(2) but is unable to carry out the inspection or examination at the prescribed time due to delay caused by lack of preparation on the part of the owner or user, the owner or user is liable to the following surcharges in addition to the prescribed fees: Copies of this Statutory Instrument can be obtained from the Government Printer, P.O.Box 30136, 10101 Lusaka Price K12.00 each Surcharge payable for lifting machinery which is not prepared for examination at specified time 6 8 Statutory Instruments 9th February, 2018 (a) where there has been a delay of one hour or less, one thousand penalty units; and (b) where there has been a delay of more than one hour, a surcharge equal to the basic fees.

§ 6Where a competent person suspends the operation of anyProvision

If a competent person suspends lifting machinery on safety grounds, the owner or user must pay a fee equal to one and a half times the basic inspection or examination fee. No suspension fee is payable if the suspension is due to decommissioning.

6. Where a competent person suspends the operation of any lifting machinery on safety grounds, the owner or user of the lifting machinery shall pay a fee of one and half times the basic fee for the inspection or examination of the lifting machinery, except that where the suspension is due to decommissioning of the lifting machinery a suspension fee shall not be payable.
