§ 3(I) A person who intends to grow tobacco for purposes ofProvision

A person who wants to grow tobacco for sale on a licensed sales floor must apply to the Tobacco Board of Zambia for registration and pay the prescribed fee.

3. (I) A person who intends to grow tobacco for purposes of sale on a licensed sales floor shall apply to the Tobacco Board of Zambia for registration as a grower in Form I set out in the First Schedule on payment of a fee set out in the Second Schedule. % (2) The Tobacco Board of Zambia shall, within thirty days of receipt of an application under subregulation (l), grant or reject the application. (3) The Tobacco Board of Zambia shall, in considering an application made under subregulation (I), be sati fisfied that the applicant has (a) proof of a field readily available for planting of tobacco; and (b) adequate available tobacco curing and storage facilities. {4) The Tobacco Board of Zambia shall, where an applicant meets the requirements of the Act and these Regulations, grant the application under subregulation {2) and issue the applicant with a certificate of registration in Form II set out in the First Schedule. (5) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia rejects an application for registration as a grower under subregulation (2), inform the applicant in Form III set out in the First Schedule, stating the reasons for the rejection. § 12(1) The following classes of tobacco shall be grown or soldProvision

Only the listed classes of tobacco may be grown or sold in the Republic, and they must be registered with the Tobacco Board of Zambia within the period set by regulation 4.

12. (1) The following classes of tobacco shall be grown or sold in the Republic: (a) flue cured virginia; (b) oriental; (c) sun cured burley; (d) air cured burley; (e) dark fire cured virginia; and Classes of tobacco e (j) any other class of tobacco that the Tobacco Board of Zambia may approve. (2) The classes of tobacco referred to under subregulation (I) shall be registered with the Tobacco Board of Zambia between the periods specified under regulation 4.

§ 13(1) A grower of saleable tobacco shall mark a bale ofProvision

A grower of saleable tobacco must mark each bale with the grower’s registered or allotted number and attach a tag with specified details.

13. (1) A grower of saleable tobacco shall mark a bale of saleable tobacco with that grower's registered or allotted number. § 14A holder of a sales floor licence shallProvision

A holder of a sales floor licence must provide sale information and paperwork, keep bale tickets properly prepared and attached, handle tobacco and receipts in the required order, provide insurance, prepare grower statements within 48 hours, and submit monthly returns.

14. A holder of a sales floor licence shall (a) furnish the sales supervisor with a sales programme before each sale and provide the following information relating to the bales of saleable tobacco that are on the licensed sales floor in the order in which they are laid: (i) the registered number of each seller; (ii) the name of each seller; (iii) the number of bales of saleable tobacco in a consignment; (iv) whether the bales of saleable tobacco are up for sale for the first time or whether they are re handled bales, buyers' re sales, or bales which have bad bale tickets crossed at a previous sale or if the bales fall into any other category and what that category is; and (v) whether the bales of saleable tobacco have been graded by a grader and the name of the grader; (b) ensure that the bale ticket clearly shows the following particulars: (i) the registered number of the seller; (ii) the net weight; (iii) the buyer's code letter; (iv) the buyer's grade classification, if available; and (v) the price per kilogramme; (c) ensure that there are adequate copies of the bale tickets to meet the sale requirements for the selling season; (d) ensure that after a sale, a bale ticket is securely attached to the outside of the bale of saleable tobacco to which the bale ticket relates; • • • 22nd May, 2026 Statutory Instruments 853 {e) during a sale, ensure to repack the saleable tobacco and securely resew all bales; (f) be responsible for any loss occasioned by the errors of the holder of a sales floor licence in weighing or otherwise and make good any loss so occasioned; (g) furnish the sales supervisor with the infonnation relating to the future programme of sales; (h) receive and issue receipts for tobacco bookings in order of arrival at the sales floor premises; () provide, at the expense of the holder of a sales floor licence, insurance to cover the loss of, or damage to any seller of tobacco from time of receipt to completion of sale; (j) prepare grower's statements within forty-eight hours after capturing the bale tickets for the purchased tobacco; and (k) provide returns of the purchased tobacco to the Tobacco Board of Zambia at the monthend of each month during the tobacco selling season.

§ 15A holder of a sales floor licence shall notProvision

A holder of a sales floor licence must not stack tobacco above 244 cm without a sales supervisor’s permission, and must not store tobacco without written authority from the Tobacco Board of Zambia.

15. A holder of a sales floor licence shall not - (a) stack tobacco more than two hundred and forty four centimeters above the level on which the bottom bale of saleable tobacco rests without the pennission of a sales supervisor; and {b) store tobacco, without the written authority of the Tobacco Board of Zambia.

A seller of tobacco must pack tobacco in a bale that meets the stated covering and stitching requirements.

16. A seller of tobacco shall ensure that the tobacco is packed in a bale that- Storage of saleable tobacco Packing of saleable tobacco (a) has an outer covering of hessian, in good condition, or such other material that may be approved by the Tobacco Board of Zambia; (b) has an inner covering of new or undamaged waterproof paper or such other materials that the buyer may request; and (c) is properly sewn with twine, in good condition, as follows: (i) the twine shall not be made of sisal or jute; (ii) a single stitch shall not exceed eight centimetres in length; 854 Statutory Instruments 22nd May, 2026 Weight of packed saleable tobacco Prohibition of sale of nested tobacco (iii) a gap between the stitches shall not exceed eight centimetres in length; and (iv) the stitches shall be locked on the ends of the bale near the comers.

§ 17( 1) A seller of saleable tobacco shall pack saleable tobaccoProvision

A seller of saleable tobacco must pack tobacco in bales meeting the stated weight and size limits, and must not sell certain split bales below the minimum weights.

17. ( 1) A seller of saleable tobacco shall pack saleable tobacco in bales • (a) weighing at least twenty three kilogrammes net but not more than one hundred and thirty five kilogrammes net; and (b) having dimensions of eighty six centimetres long, sixty one centimetres high and not more than sixty six centimetres wide. (2) Despite subregulation (I), a seller of saleable tobacco shall not offer for sale - (a) a split bale of virginia flue cured tobacco weighing less than forty five kilogrammes net; and (b) a split bale of burley tobacco weighing less than fourteen kilogrammes net.

§ 18( 1) A grower shall not offer for sale any tobacco which isProvision

A grower must not sell nested tobacco. A buyer who discovers nested tobacco during a sale must report the grower to the Tobacco Board of Zambia within 48 hours. The Board must inspect the tobacco immediately, report back to the buyer within 7 days, confiscate nested saleable tobacco if confirmed, and de-register a grower’s number after a second or later finding, then notify licensed buyers and sales floor licence holders.

18. ( 1) A grower shall not offer for sale any tobacco which is nested. (2) A buyer shall, where the buyer discovers during a sale that the tobacco is nested, report the grower whose tobacco is nested to the Tobacco Board of Zambia within forty eight hours of the discovery. (3) The Tobacco Board of Zambia shall, on receipt of a report under subregulations (2), immediately inspect the tobacco and report the result to the buyer within seven days of the inspection. (4) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia confirms that the bale of saleable tobacco is nested, confiscate the bale of saleable tobacco. § 20( 1) A grower shall pay a levy of two percent of the totalProvision

Growers must pay a 2% levy on leviable tobacco sold. Buyers and licensed sales floor holders must withhold and remit the levy, and submit specified returns to the Tobacco Board of Zambia.

20. ( 1) A grower shall pay a levy of two percent of the total sales value of leviable tobacco sold by the grower. (2) A buyer of leviable tobacco shall withhold the levy referred to in subregulation (I), on the day of sale of that leviable tobacco. (3) A buyer who withholds a levy in accordance with subregulation (2) shall, on the fourteenth day of every month after withholding the levy- (a) submit to the Tobacco Board of Zambia a withheld levy return in Form XIII set out in the First Schedule; and (b) remit the withheld levy to the Tobacco Board of Zambia. ( 4) A holder of a sales floor licence shall, where a holder of the sales floor licence sells leviable tobacco on behalf of a grower, withhold the levy and remit the levy to the Tobacco Board of Zambia within seven days of withholding the levy. (S) The remittance of a levy referred to under this regulation shall be supported by the sales statement from the holder of a sales floor licence on which the buyer purchased the tobacco. (6) The Tobacco Board of Zambia shall, on receipt of the levy remitted under this Part, issue to the buyer a receipt relating to the remittance of the levy. (7) The holder of a sales floor licence shall submit a monthly return on the sales and collection and remittance of the levy to the Tobacco Board of Zambia in Form IX set out in the First Schedule. (8) The Tobacco Board of Zambia may, at any time after the receipt of the remittance, where a person does not satisfy the Tobacco Board of Zambia that the return in respect of a payment is correct, direct the person making the remittance to produce evidence of all relevant transactions in leviable tobacco for the purposes of determining the amount of levy payable. 856 Statutory Instruments 22nd May, 2026 PART VI GENERAL PROVISIONS Variety of tobacco

§ 4The period ofregistration as a grower shall be from the 1stProvision

A grower’s registration period for tobacco runs from 1 April to 30 November each year.

A grower certificate holder may apply to renew the certificate before it expires, and the Tobacco Board of Zambia must decide the application within 30 days.

5. ( 1) A holder of a certificate of registration as a grower may, three months before the expiry of the certificate of registration, apply to the Tobacco Board of Zambia for renewal of the certificate of registration in Form I set out in the First Schedule on payment of a fee set out in the Second Schedule. (2) The Tobacco Board of Zambia shall, within thirty days of receipt of an application under subregulation ( l ), grant or reject the application. 22nd May, 2026 Statutory Instruments 849 (3) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia grants an application for renewal under subregulation (2), renew a grower's certificate of registration if the applicant has (a) proof of a field readily available for planting tobacco; {b) adequate available tobacco curing and storage facilities; (c) not committed an offence under the Act or these Regulations; (d) in the case of a grower who is sponsored to grow tobacco for purposes of sale, not defaulted on any term of sponsorship at least for three consecutive selling seasons as a grower; and (e) submitted returns relating to a grower as required under the Act. (4) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia rejects an application for renewal under subregulation (2), inform the applicant in Form Ill set out in the First Schedule, stating the reasons for the rejection.
§ 6( 1) A grower shall submit to the Executive Director a return Returns byProvision

A grower must submit a tobacco return in Form IV to the Executive Director, and the Executive Director must verify it and record it in the Tobacco Board’s database.

6. ( 1) A grower shall submit to the Executive Director a return Returns by relating to the grower's tobacco in Form IV set out in the First grower Schedule. Application for licence (2) The Executive Director shall, on receipt of the return referred to under subregulation (I), verify the infonnation submitted by the grower and record the return in a database maintained by the Tobacco Board of Zambia.

§ 7(I) A person who intends to carry on a business as a grader,Offence

People who want to act as a grader or buyer, or use premises as a tobacco sales floor, must apply to the Tobacco Board of Zambia for a licence and pay the stated fee.

7. (I) A person who intends to carry on a business as a grader, buyer, or use any premises as a sales floor for the sale of tobacco shall apply to the Tobacco Board of Zambia for a licence in Fonn V set out in the First Schedule on payment of a fee set out in the Second Schedule . (2) The Tobacco Board of Zambia shall, within thirty days of receipt of an application under subregulation (I), grant or reject the application. (3) The Tobacco Board of Zambia shall issue an applicant with a licence if the applicant has (a) in the case of a buyer's licence (i) specified the type of tobacco to be bought and the licensed sales floor where the tobacco shall be bought; and (ii) not committed any offence under the Act; • 850 Statutory Instruments 22nd May, 2026 (b) in the case of a grader's licence, not committed any offence under the Act; and (c) in the case of a sales floor licence - (i) a sales floor computer management system that is linked to the Tobacco Board of Zambia database maintained and kept for purposes of sale of tobacco; and (ii) not committed any offence under the Act. · [ Renewal of licence (4) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia rejects an application under subregulation (2), notify the applicant in Form m set out in the First Schedule, stating the reasons for the rejection. (5) The Tobacco Board of Zambia shall, where an applicant meets the requirements of the Act and these Regulations, grant the application under subregulation (2) and issue the applicant with a licence in Form VI set out in the First Schedule.
§ 8(I) A holder of a licence who intends to renew a licenceProvision

A licence holder who wants to renew must apply to the Tobacco Board of Zambia in Form VII and pay the fee in the Second Schedule. If the Board grants the application, it renews the licence in Form VI, subject to compliance and return-filing conditions.

8. (I) A holder of a licence who intends to renew a licence shall apply to the Tobacco Board of Zambia for renewal of that licence in Form VII set out in the First Schedule on payment of a fee set out in the Second Schedule. (2) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia grants the application under subregulation (I), renew a licence in Form VI set out in the First Schedule if the applicant has - (a) complied with the requirements of the Act and these Regulations; (b) in the case of a buyer's licence, submitted returns in Form VIII set out in the First Schedule of all tobacco purchased by the applicant in the previous month; and (c) in the case of a sales floor licence, submitted returns in Form IX set out in the First Schedule. • Suspension or revocation of certificate of registration or licence
§ 9(I) The Tobacco Board of Zambia shall, where the TobaccoProvision

The Tobacco Board of Zambia must notify certificate or licence holders before it intends to suspend or revoke them, and also notify them when suspension or revocation happens.

9. (I) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia intends to suspend or revoke a certificate of registration or licence issued under these Regulations, notify the holder of the certificate of registration or licence of the Tobacco Board of Zambia's intention to suspend or revoke the certificate of registration or licence in Form X set out in the First Schedule. 22nd May, 2026 Statutory Instruments 851 (2) The Tobacco Board of Zambia shall, where the Tobacco Board of Zambia suspends or revokes the certificate of registration or licence, notify a holder of a certificate of registration or licence of the suspension or revocation in Form XI set out in the First Schedule. 4 +
§ 10(I) A holder of a certificate of registration orlicence whoseProvision

If a registration certificate or licence is lost or destroyed, the holder may apply in writing to the Tobacco Board of Zambia for a duplicate, and a fee is payable.

10. (I) A holder of a certificate of registration orlicence whose certificate of registration or licence is lost or destroyed may apply to the Tobacco Board of Zambia, in writing, for a duplicate certificate of registration or licence on payment of a fee set out in the Second Schedule. Duplicate certificate of registration or licence (2) The Tobacco Board of Zambia may, within thirty days of receipt of an application under subregulation (I), issue to the applicant a duplicate certificate of registration or licence in Form II or Form VII set out in the First Schedule, respectively.

This provision revokes four tobacco-related statutory instruments and sets transitional validity dates for existing certificates and licences.

24. ( 1) The following statutory instruments are revoked: (a) the Tobacco (Marketing and Licensing) Rules, 1968: (b) the Tobacco (Registration of Growers) Regulations, 1968; (c) the Tobacco (Sale of Non-Auctionable Tobacco) Regulations, 2018; and (d) the Tobacco Levy Regulations. 2018.
