Negou-se provimento ao agravo interno porque o Tribunal de origem enfrentou de forma clara e suficiente as questões suscitadas (não havendo ofensa ao art. 535 do CPC/1973), a jurisprudência do STJ estabelece que a multa decendial é limitada ao valor da obrigação principal sem acréscimo de juros (art. 412 CC), e não ocorreu alteração do título executivo nem violação da coisa julgada ao afastar juros apenas sobre a multa decendial.
