Article 2(4) of Regulation No 4045/89 does not require that, when a Member State extends the period under scrutiny, that period must end during the preceding scrutiny period; it may also end after that period. The provision does not confer on operators a right to oppose inspections broader than those envisaged by the provision, and non-conformity with the scrutiny period rules does not render inspections unlawful with respect to operators.
