Where the Community origin of grape musts cannot be established due to acquisition from a non-existent company, the producer cannot benefit from storage aid. Article 17(1)(b) of Regulation No 1059/83 does not apply to such fundamental breaches. In absence of sectoral or national penalty provisions, Regulation No 2988/95 requires repayment of all aid unduly paid as an administrative measure, not a penalty.
