Ratio Decidendi

The refusal to provide the applicant association with access to any decisions of the Tyrol Real Property Transactions Commission was disproportionate and not necessary in a democratic society, given the public interest in the subject matter, the applicant's role as a social watchdog, and the lack of publication of any decisions by the Commission. The reasons given by the domestic authorities, while relevant, were not sufficient to justify a complete refusal. There was therefore a violation of Article 10 of the Convention.

Court Disposition

Application admissible; violation of Article 10; no violation of Article 13; costs awarded.

Orders

  • The respondent State is to pay the applicant association EUR 7,500 within three months for costs and expenses, plus any tax chargeable.
  • From expiry of three months until settlement, simple interest shall be payable at the marginal lending rate of the European Central Bank plus three percentage points.
