Ratio Decidendi

The complete refusal by the Commission to provide access to any of its decisions was disproportionate and not necessary in a democratic society. The reasons given by the domestic authorities, though relevant, were not sufficient. The Commission's information monopoly prevented the applicant association from carrying out its research and participating meaningfully in legislative processes. There was therefore a violation of Article 10. However, the applicant association did have access to an effective remedy under Article 13, as the negative conflict of jurisdiction was ultimately resolved and the Constitutional Court ruled on the merits.

Court Disposition

Application admissible; violation of Article 10; no violation of Article 13; costs awarded.

Orders

  • The respondent State is to pay the applicant association EUR 7,500 within three months for costs and expenses, plus any tax chargeable.
  • From expiry of three months until settlement, simple interest is payable at the marginal lending rate of the European Central Bank plus three percentage points.
