Ratio Decidendi

The refusal to provide any access to the Commission's decisions was disproportionate and not necessary in a democratic society, given the applicant's legitimate public interest role and the lack of alternative access to such information. The reasons given by the domestic authorities, while relevant, were not sufficient to justify a complete denial. There was thus a violation of Article 10. However, the applicant had an effective remedy under Article 13, as the negative conflict of jurisdiction was ultimately resolved and the Constitutional Court ruled on the merits.

  • The respondent State is to pay the applicant association EUR 7,500 within three months for costs and expenses, plus any applicable tax.
