Ratio Decidendi

Regulation No 834/2007, in particular Article 3 and Article 14(1)(b)(viii), read in light of Article 13 TFEU, does not authorize the placing of the EU organic logo on products derived from animals slaughtered in accordance with religious rites without first being stunned, even if such slaughter complies with Regulation No 1099/2009. Slaughter without pre-stunning does not minimize animal suffering to the level required for organic production.
