Article 3(1)-(3) of Directive 2009/73/EC, read in light of Articles 36 and 38 of the Charter, does not preclude national legislation requiring customers to bear the costs of public service obligations imposed on natural gas undertakings, provided the legislation pursues a general economic interest, complies with proportionality, and the obligations are clearly defined, transparent, non-discriminatory, verifiable, and guarantee equal access. Exempting the regulatory authority from certain procedural requirements is not precluded by Directive 2009/73/EC, provided the resulting acts are justified, published, and subject to judicial review.
