Ratio Decidendi

National rules allocating a single fixed quota to all producers with development plans, regardless of plan objectives, are incompatible with Article 3(1) of Regulation No 857/84. However, rules limiting eligibility to producers below a specified ceiling are permissible. Allocation of supplementary reference quantities based on freed quotas within each purchaser is not precluded if subsequent adjustments neutralize differences between producers affiliated to different purchasers. The principle of legitimate expectations does not preclude reductions in reference quantities for producers with development plans unless reductions target them specifically.
