Aranyosi (Judgment) [2016] EUECJ C-404/15 (05 April 2016)
Where there is objective, reliable, specific, and properly updated evidence of deficiencies in detention conditions in the issuing Member State, the executing judicial authority must determine whether there are substantial grounds to believe that the individual will be exposed to a real risk of inhuman or degrading treatment if surrendered. The authority must request supplementary information from the issuing authority and postpone its decision until it can discount such a risk. If the risk cannot be discounted within a reasonable time, the authority must decide whether to end the surrender procedure.
